What Does Not Qualify as Civil Litigation?

Because so many different types of cases fall under the umbrella of civil litigation, it may be easier to look at the types of cases that do not qualify as civil litigation. Criminal defense cases and family law cases are not civil lawsuits because they are not handled in civil court.

Criminal cases take place within the criminal justice system, for example, and family law cases unfold in family courts.

What Does a Civil Litigator Do? 

A civil litigator prepares cases for trial and represents their clients during said trials. Because taking cases to court is expensive and time-consuming for their clients, however, a civil litigation attorney will also do everything they can to settle cases before they reach trial.

  • Evaluates the strengths and weaknesses of your case
  • Advises you on your rights and legal options
  • Assists in investigation and discovery
  • Leads settlement discussions
  • Handles judge and jury trials whenever necessary

Usually, the parties in a lawsuit agree to settle when evidence begins to emerge during discovery. Still, a good civil litigation attorney will not advise you to accept less than you deserve.

What Does a Business Litigation Attorney Do?

Business litigation attorneys are similar to civil litigation attorneys, but they focus on managing small and large legal issues that businesses may need to handle as part of their operations. Again, business litigation attorneys do what they can to avoid litigation.

For example, your business lawyer might help you negotiate a contract that is enforceable and favorable for both parties. They can also help you if one party breaches that contract, and you need to seek civil remedies.

In addition to handling every phase of business litigation, business litigation attorneys keep the best interests of your business in mind and handle things with a “big picture” point of view.

Keep in mind that some business lawyers are not civil litigation attorneys. Civil litigation attorneys are always prepared to file lawsuits and go to court on your behalf if necessary.

What Is the Difference Between a Lawyer and a Litigator?
