Business & Civil Litigation

Miami Business & Civil Litigation Lawyers

Helping You Resolve Civil Disputes in Miami and Beyond

Civil litigation is the process in which civil matters are resolved in court. Business law and other practice areas fall under civil litigation, but a case only rises to the level of civil litigation when one party files a lawsuit against the other.

At Jurney & De La Grana, P.A., our Miami civil litigation attorneys handle personal injury claims, business suits, and all other forms of civil litigation. We are prepared to go to court in every case and offer personalized representation to each client.

Whether you are considering a lawsuit or want to resolve a legal issue before it reaches litigation, our team is here to help.

What Are the Most Common Civil Lawsuits?

Personal injury claims and contract disputes are some of the most common types of cases that appear in civil court. Other common civil lawsuits include:

  • Property disputes
  • Conflict between business partners
  • Business torts
  • Class-action cases
  • Complaints against the city

When someone gets hurt or loses money, they may be entitled to compensation. Sometimes, they can get this compensation by filing a claim against an insurance company. When insurance companies are unavailable or do not cooperate, litigation may be necessary.

What Does Not Qualify as Civil Litigation?

Because so many different types of cases fall under the umbrella of civil litigation, it may be easier to look at the types of cases that do not qualify as civil litigation. Criminal defense cases and family law cases are not civil lawsuits because they are not handled in civil court.

Criminal cases take place within the criminal justice system, for example, and family law cases unfold in family courts.

Jurney & De La Grana, P.A. helps clients in and around Miami with civil lawsuits and criminal defense, but we do not handle family law cases.

What Does a Civil Litigator Do?

A civil litigator prepares cases for trial and represents their clients during said trials. Because taking cases to court is expensive and time-consuming for their clients, however, a civil litigation attorney will also do everything they can to settle cases before they reach trial.

As such, a civil litigator:

  • Evaluates the strengths and weaknesses of your case
  • Advises you on your rights and legal options
  • Assists in investigation and discovery
  • Leads settlement discussions
  • Handles judge and jury trials whenever necessary

Usually, the parties in a lawsuit agree to settle when evidence begins to emerge during discovery. Still, a good civil litigation attorney will not advise you to accept less than you deserve.

What Does a Business Litigation Attorney Do?

Business litigation attorneys are similar to civil litigation attorneys, but they focus on managing small and large legal issues that businesses may need to handle as part of their operations. Again, business litigation attorneys do what they can to avoid litigation.

For example, your business lawyer might help you negotiate a contract that is enforceable and favorable for both parties. They can also help you if one party breaches that contract, and you need to seek civil remedies.

In addition to handling every phase of business litigation, business litigation attorneys keep the best interests of your business in mind and handle things with a “big picture” point of view.

Keep in mind that some business lawyers are not civil litigation attorneys. Civil litigation attorneys are always prepared to file lawsuits and go to court on your behalf if necessary.

What Is the Difference Between a Lawyer and a Litigator?

While similar, lawyers and litigators are not the same thing. Every litigator is a lawyer, but not every lawyer is a litigator. In general, lawyers provide legal advice and assistance and help their clients draft legal documents, and litigators focus on representing their clients in court.

Some firms bring outside litigators in to assist them, but Jurney & De La Grana, P.A. proudly provides business and civil litigation services in Miami.

Each case receives our undivided attention, and we offer aggressive and relentless representation because we truly care about our clients.
